Terms of Use and Conditions Terms of Use and Conditions ("Terms and Conditions") ====================== Last updated: 12/06/2021 Please read these Terms of Use and Conditions ("Terms", "Terms of Use and Conditions") carefully before using the www.on-boardoccasions.co.uk website (the "Service") operated by On-Board Occasions ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of the Terms and Conditions then you may not access the Service. Links To Other Web Sites ------------------------ Our Service may contain links to third-party web sites or services that are not owned or controlled by On-Board Occasions. On-Board Occasions has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. Governing Law ------------- These Terms and Conditions shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect. These Terms and Conditions constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service. Changes ------- We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material we will try to provide at least 30 days notice prior to any new Terms and Conditions taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms and Conditions. If we have to contact you, we will do so by using the contact details you have provided to us via the method you chose to communicate with us in the first instance unless otherwise agreed. If you want to know more we encourage you to please take a look at our Privacy Policy. We operate a 'zero-tolerance' policy towards violent and abusive behaviour. If you or anyone in your party is violent or abusive or intimidating our staff, we can refuse to carry out/ finish our service with you. Failure to comply with this could result in a non-refundable deposit. Our Equipment ------- Please note that our equipment can create flashing lights, UV lights and loud music. Please note that we may hold you liable in the event of any loss or damage to any of our property or equipment. Failure to keep our property and equipment free from any loss or damage could result in a non-refundable deposit. Although our Party House Package is weatherproof, due to Health & Safety our parties are weather permitted. In the event of heavy rain, thunder storms, high winds or snow, as a goodwill gesture, we may be able to accommodate your request to change your booking date. Under 18s ------- Under 18s must be supervised by an adult at all times, who shall be responsible for them whilst using our services. On-Board Occasions will not be responsible for any underage drinking or participation of any illegal substances. Payment ------- On-Board Occasions accepts payment by Mastercard Credit, Visa Credit and Visa Debit cards. You must pay for the booking and deposit in full, before the Booking is accepted and confirmed. Deposit ------- On-Board Occasions requires a deposit of £100 on all bookings, this deposit is fully refundable; however in the case of a cancellation we require a minimum of 7 days notice. Failure to notify us 7 days prior to the date of the event is to take place could result in a non-refundable deposit. Refunds ------- You would be eligible for a refund if you are able to provide us with 7 days notice prior to the date of your online booking by contacting the customer service team via email with the subject heading “Cancelation”. Otherwise, we do not offer refunds and are not legally obliged to do so (save in the limited circumstances set out in these Terms). You will not be entitled to receive a refund in the following circumstances (for example): • if you change your mind after making your Booking; • if you have missed your allocated time due to different circumstances and we are unable to hold your allocated time or amend your Booking; • if we are unable to make changes to your Booking as requested by you, or the consequences of making such changes are unacceptable to you - if we arrive at the location and the weather was never or is no longer permitting for set up of the equipment Arrival ------- On arrival, a member of our staff will need access via a side entrance, back gate or garage access if the location is at a residential property. Please note we will NOT take our equipment through the residential property, if we arrive at the residential property and there is no access then this could result in a non-refundable deposit, we also require a clear access, as this will delay our set up and potentially make us late for our next booking. When booking please make the staff aware of any parking restrictions, obstructions or security features such as coded or padlocked gates. Please ensure the location is clean and there is no feces from any animals/ pets. Alterations to your booking ------- Please note if you decide to change location which is considerably further than your original destination, extra fees will apply accordingly. COVID-19 ---------- In the event of a full national lockdown, where you are not allowed to socialise with any other household, then we will give you a credit to rearrange the date. We will NOT provide a refund. If in the unfortunate event of the hirer catching COVID-19 we will NOT provide a refund, however as a goodwill gesture, we may be able to accommodate your request to change your Booking date. This is on the basis that the remaining payment is made, otherwise your deposit will not be refunded. Your data will help us to respond to your queries and to provide you with information and costs regarding hiring our products. Should you choose to enter into a hire/purchase contract with On-Board Occasions, we will use this information to issue contracts and raise invoices for payment. We may need to use your data for the management of supplier related activities, such as selecting suppliers. We may use your personal data to keep in contact with you to discuss a quotation we have provided to you, at your request. With your permission, we may use your data to keep you informed by email/telephone of special offers, promotions and events which we think may be of interest to you. You can opt out of this at any time. Will we share your data with anyone? We may need to share your data with trusted third parties to fulfil a contract with you. For example, delivery couriers, sub-contracted suppliers or freelance crew. We will only pass on data with your permission to do so, and we follow the policy below to keep your data safe and protect your privacy: - • We will only provide the information they need to perform their specific services and they may only use your data for the exact purposes we specify. - • We will work closely with them to ensure that your privacy is respected and protected at all times.
